The official participation rules of Wellis Hungary’s review prize game

The Prize Campaign Regulation (hereinafter: Regulation) refers to the review prize campaign in Wellis Hungary Plc.’s (hereinafter: Organiser) organisation, available on www.wellispromo.com web page (hereinafter: Prize Campaign interface).

The organiser of the Prize Campaign is Wellis Hungary Ltd. (1118 Budapest, Budaörsi út 31/C).

By participating, the participant of the Prize Campaign accepts the provisions of the present Regulation and considers their content to be obligatory on His/Her part, therefore we kindly request you to carefully read the Regulation before Participating in the Prize Campaign!

By participating, the participant of the Prize Campaign accepts the provisions of the present Regulation without the need of further legal steps and automatically and regards its contents as obligatory on His/Her part.

The conditions for applying to the Prize Campaign are internet access and the acceptance of the present regulation, as well as the data management policy of Wellis Hungary Plc.

Organiser will publish the Regulation on the Prize Campaign interface and will ensure that the Regulation is continuously accessible during the Prize Campaign.

Organiser reserves the right to modify the Regulation any time if justified.

I. Organiser of the Prize Campaign

The Wellis review prize campaign’s (hereinafter: Prize Campaign) is organiser and therefore the data controller for personal data related to the campaign is Wellis Hungary Ltd. (1118 Budapest, Budaörsi út 31/C, tax number: 25584864-2-43, company registration number: 01-10-048882), who shall act in accordance with the present Regulation.

II. Conditions for Participation

Individuals who write a review of a Wellis product in their possession on xxxx landing page according to the present Regulation can participate in the Prize Campaign.

All persons over 18 years of age, who purchased a Wellis product in the past 18 years can participate in the Prize Campaign. Excluded from the Prize Campaign are the Organiser and all its employees, as well as the employees of any third party involved in the organisation of the Prize Campaign, and all natural or legal persons performing contract-based commissions or business activities, furthermore (close) relations of the employees or officials of these persons / organisations as it is specified in Section 1 of Act V. of the Civil Code of 2013 (hereinafter: Cciv.) 8:1. –

Individuals who have given their data incorrectly, incompletely, or not at all during the registration process may not participate in the Prize Campaign.

The individual participating in the Prize Campaign is obliged to familiarise themselves with the provisions of the Regulation before participating in the Prize Campaign, Organiser does not take responsibility for any potential consequences of failure to do so.

In order to participate in the Prize Campaign, you may only register using your own data. In case the individual participating in the Prize Campaign uses an email address that is not registered by themselves, Organiser excludes any liability for disputes related to the Prize Campaign and arising from authorisation to use the email account.

Participation in the Prize Campaign may involve data traffic, the potential cost of which is borne by the individual participating in the Prize Campaign, the cost rate may depend on the data provider, service fee package and construction of the individual participating in the Prize Campaign.

The individual participating in the Prize Campaign acknowledges that the contents and performance of the Prize Campaign’s technical infrastructure, as well as the speed of message and data transmission or response on the server are dependent on technology, therefore these may be adversely affected by factors outside the Organiser, such as, but not limited to: connection problems, server computer performance, network overload and congestion, coverage, and maintaining a secure network connection. Organiser is free from all liability in the previously mentioned matters.

At the end of the Prize Campaign, Organiser will get in touch with the winners for the verification of their data. The participants of the Prize Campaign undertake to cooperate with Organiser to receive the prize. Furthermore, the participants of the Prize Campaign agree to have their photo taken by Organiser at the moment of receiving the prize and publish it on His/Her communication platforms.

Organiser shall exclude from the Prize Campaign all individuals who threaten the fairness of the Prize Campaign in any way or withdraw their consent from the annex of the present Regulation, that is the Privacy Notice (hereinafter: Privacy Notice) during the period of the Prize Campaign or prior to drawing the winner. Organiser will not send a separate notice to the participant of the Prize Campaign about the exclusion.

By registering to the Prize Campaign and accepting the present Regulation, the participant of the Prize Campaign declares that all reviews submitted by Him/Her are His/Her own intellectual property and without claim by a third party. Organiser excludes all liability in connection with legal disputes arising from plagiarism or other intellectual property.

In the event that any authority or court initiates a claim or proceedings against Wellis Hungary Plc. as a consequence of or relating to the behaviour of the participant of the Prize Campaign, the person participating in the Prize Campaign is obliged to take all actions required by Wellis Hungary Plc. and reimburse all damages, property detriments and expenses suffered by Wellis Hungary Plc. as a consequence of or relating to the participant’s unlawful behaviour.

Besides the above-mentioned cases, Organiser is entitled to exclude from the Prize Campaign, in His/Her sole discretion and without a separate notice, amends, compensation or justification, any person:

  • who is not or should not have been entitled to participate in the Prize Campaign, especially if their registration does not comply with the requirements of the present Regulation, or violates the law in any way.
  • who is Organiser’s employee, or relative of these persons as it is defined in Cciv., Act 8 :1. § Section (1) point 2.
  • who violates the provisions of the present Regulation in any way, or violates the law, another person’s rights or legitimate interest in connection with the Prize Campaign, or if suspicion of these arises.
  • who does not get in touch with Organiser until the given deadline.
  • who transmits false or incorrect data to Organiser, or attempts in any way to entitle a false or other-than-real person to the prize in the Prize Campaign, or registers a person other than the original participant of the Prize Campaign, as well as
  • anyone whom the Organiser deems fit to exclude.
  • who has participated in the Campaign violating copyrights of another individual, or if the suspicion of this fact arises in connection with them.

The individual participating in the Prize Campaign declares that the data given by Him/Her during His/Her registration is corresponding to reality.

III. Description of the Prize Campaign

The condition to participate in the Prize Campaign is accepting the present regulation, as well as submitting at least one and a maximum of three valid application(s).

Period of the Prize Campaign

The Prize Campaign is organised between November 8, 2021 and December 31, 2021.

The applications received before the beginning or after the end of the Prize Campaign period are not valid, therefore do not take part in the Campaign. One individual who submits a review is entitled to receive a total of one prize.

Organiser does not take responsibility for consequences arising from carelessness on part of the individual participating in the Prize Campaign and does not especially extend the deadline in such cases.

Content requirements for application:

The applications include at least 1 review of a product distributed by Organiser, published on Organiser’s Facebook page: https://www.facebook.com/wellis.eu 

The prizes allocated during the Prize Campaign:

All individuals who submit a review will receive 1 towel with Wellis inscription and 1 bathrobe with Wellis inscription – worth 15.980 HUF (42 EUR)

All individuals who submit a review with picture will receive 2 towels with Wellis inscription and 2 bathrobes with Wellis inscription – worth 31.960 HUF (84 EUR)

Every two weeks a winner will be picked for a WIS water analyser worth 177.900 HUF. (493 EUR)

IV. Notification of winners and reception of the prize

The Organiser informs the winner about further steps after the completed documents have been uploaded. Organiser will get in touch with the winner via the email address given now of registration.

In the event that contact is not made with the winners in 8 calendar days after the notification, or if the information necessary for the delivery of the prizes was not or not completely and truthfully granted, as well as in case the winner submits a written notice, in which He/She declares His/Her reluctance to receive the prize, the Organiser reserves the right not to deliver the prize and declare said application invalid and the winner excluded from the Prize Campaign.

The Organiser does not take responsibility for consequences arising from carelessness on the part of the individual participating in the Prize Campaign.

The prizes cannot be transferred to another person and cannot be converted to cash.

Taxes and contributions related to the prizes and determined by the Hungarian legislation in force, as well as the expenses related to postal delivery will be paid for by Organiser. Potential expenses arising from the takeover and use of the prize will be borne by the winner.

V. Responsibilities of Organiser

As a result of the free nature of the Prize Campaign, the Organiser does not guarantee the uninterruptedness of the Prize Campaign, nor is He/She to be held accountable for the suspension or termination of the Prize Campaign. The Organiser seek to remediate any potential disturbances or malfunctions that present themselves during the functioning of the Prize Campaign interface, however He/She is not to be held accountable for them. Organiser excludes any claims for damages or compensation during participation in the Prize Campaign, for expenses, damages or losses arising from or related to potential mistakes, deficiencies, malfunctions of the Prize Campaign or any delays during the Prize Campaign.

VI. Privacy Notice

Relevant data protection or other legislative provisions:

  • The 2016/679 regulation (April 27, 2016) of the European Parliament and Council (EU) – Act CXII. of 2011 on the protection of natural persons with regard to data processing and the free movement of such data, and annulment of Regulation No. 95/46/EC (general data protection regulation, GDPR) and
  • on the right to information self-determination and freedom of information (hereinafter: Information Act)

Data Controller will manage the personal data given by the Applicant confidentially and in compliance with the applicable data protection legislation, with regard to Act CXII. of 2011 on the right to information self-determination and freedom of information, Act VI. of 1998 on the protection of persons as regards the automatic processing of personal data adopted at Strasbourg on 28 January 1981, as well as the EU Regulation 2016/679 (GDPR) on the protection of natural persons regarding data processing and the free movement of such data, and annulment of Regulation No. 95/46/EC.

Data processing purpose:

The aim of processing the data of those taking part in the Campaign available on XXXXXX website and organised by Wellis Hungary Ltd., is the identification of Applicants, identification during the picking of the winner(s), general contact, and delivery of potential prizes.

Legal basis for data processing:

Data subject’s freely given consent.

Scope of the managed data:

  • Winners:
    • Applicant’s name
    • Applicant’s email address
    • Applicant’s address

Data management period

The data management period starts from entering data and ends with the withdrawal of consent.

Recipients of personal data and recipient categories:

Organiser’s colleagues involved in conducting the Prize Campaign.

Instructions about Data Subject’s rights

Data Subject may request to be further informed on the management of their personal data, or may request the correction of their personal data, as well as the deletion of said data – except for data management prescribed by legislation.

Right to be informed

Data Subject is entitled to be adequately informed about facts and information connected to data management before the start of management of their data. The present information on data management and data protection was drawn up so that the aforementioned right may be ensured.

Right to access

Data Subject may request Wellis Hungary Plc. to:

  • confirm the management of their personal data;
  • provide a copy of said data;

provide further information regarding their personal data, in particular the type of data He/She is in possession of, the way this data is being used, with whom the data may be shared, whether the data is forwarded abroad or not, in what ways the data is protected, how long the data is stored, in what ways He/She may file a complaint and finally, how Data Subject’s data was acquired.

Right to rectification

Data Subject may request that Wellis Hungary Plc. rectifies or completes their personal data that is incorrect, inaccurate, or incomplete. Before the rectification of incorrect data, Wellis Hungary Plc. may inspect the authenticity and accuracy of the data in question.

Right to erasure and right to be forgotten

Data Subject may request the erasure of their personal data:

  • if the data in concern is not necessary anymore for the purposes for which it was initially collected; or,
  • if Data Subject withdraws their consent (in case the data management is based on free will); or,
  • if Data Subject exercises their right to objection; or,
  • if the data in concern was managed in an unlawful manner; or,
  • if the erasure of the data in concern is prescribed by law.

The request of Data Subject to erase their personal data does not need to be fulfilled by Wellis Hungary Plc. if data management is necessary and justified by the following reasons:

  • to comply with legal obligations; or
  • to enforce or protect legitimate interest legally.

Right to restriction of data management (right to suspension)

Data Subject may request the restriction of management of their personal data (data suspension),

  • if rectification cannot be ensured in relation with their correctness, accuracy or authenticity (incl. the Right to rectification); or,
  • if the data management is unlawful, but Data Subject does not request the erasure of their data; or,
  • if the data in concern is not necessary anymore for the purposes for which it was initially collected, but its erasure is impeded by the enforcement of certain rights or legitimate interest in court; or,
  • if Data Subject exercised their right to protest and the inspection of Wellis Hungary Plc.’s lawfulness is not concluded.

In case the right to suspension is exercised, Wellis Hungary Plc. is still entitled to use the personal data, if:

  • consent to this has been given by Data Subject; or,
  • if the use (existence) of the data in concern is necessary to enforce certain rights or legitimate interest in court; or
  • if the use (existence) of the data in concern is necessary to protect the personal rights of another natural or legal person.

Ensuring data portability

Data Subject may request Wellis Hungary Ltd. to make available their data in a structured, transparent, and machine-readable format, furthermore Data Subject may request that the data is forwarded to another data controller.

Right to object

Data Subject may object to the management of their personal data anytime out of reasons concerning their own personal condition in case He/She considers that it is His/Her basic right to do so. Data Subject may object to the use of their personal data for direct marketing, in which case Wellis Hungary Ltd. will terminate the data management in the shortest period of time possible.

Notification of Data Subject of a personal data breach

Wellis Hungary Plc. protects Data Subject’s personal or other data according to their best of knowledge and in proportion to the risks, meanwhile operating in modern and reliable IT conditions, and selecting its partners with exceptional care. Wellis Hungary Plc. conducts their internal operations in a regulated and supervised manner, in order to prevent or avoid the smallest error, problem or incident in the context of personal data management, or should such a problem happen, detect, inspect and handle the situation accordingly. If by any chance an incident that concerns the personal data should occur and prove to be a plausibly high risk in terms of the rights and freedoms of the Data Subjects, Wellis Hungary Plc. undertakes to inform Data Subject and data protection authorities about the data protection incident without undue delay, and in accordance with the adequate form and content prescribed by applicable data protection provisions.

Automated Decision-Making in Individual Cases, including Profiling

Data Subject is entitled to not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning them or affects them similarly significantly. Wellis Hungary Plc. does not operate procedures that use automated decision-making.

Right to lodge a complaint with a supervisory authority

Right to an effective judicial remedy against a supervisory authority

You are entitled to an effective judicial remedy against a a legally binding decision of a supervisory authority concerning You.

Right to effective judicial remedy against Data Controller or Data Processor

You are entitled to an effective judicial remedy, if You consider that Your rights have been violated because of inadequate personal data management.

Participation in the campaign and sharing necessary personal data is based on free will.

Organiser will use the given data as Data Controller for the purposes specified in the Campaign’s regulation. If Organiser entrusts a third party in order to handle certain subtasks of the Campaign – such as delivering the package to the winners – Organiser will have to forward Applicant’s name, address and phone number to this partner in order to conduct the Prize Campaign.

Organiser guarantees that the data management is carried out in full accordance with current legal provisions.

Should the conditions of data management change, Organiser shall inform the Applicants about any changes.
